Les présentes Conditions Générales d'Utilisation et de Service (« CGU ») régissent l'accès et l'utilisation du service ElixMail (« le Service ») édité par NovaForma Studio. En créant un compte ou en utilisant le Service, vous acceptez sans réserve l'intégralité des présentes CGU. Si vous n'acceptez pas ces conditions, vous ne devez pas utiliser le Service.
L'utilisation du Service ElixMail est subordonnée à l'acceptation expresse et préalable des présentes CGU. L'inscription, la connexion ou toute utilisation du Service vaut acceptation pleine et entière, sans réserve, de l'ensemble des stipulations qui suivent. L'Utilisateur reconnaît avoir pris connaissance des CGU et déclare expressément les accepter avant toute utilisation du Service.
ElixMail est un service SaaS (Software as a Service) de messagerie professionnelle assistée par intelligence artificielle, comprenant notamment :
Le Service est hébergé en France sur l'infrastructure IONOS Cloud, conformément au RGPD et à l'arrêt Schrems II de la CJUE.
L'accès au Service nécessite la création d'un compte avec une adresse email valide. L'Utilisateur s'engage à fournir des informations exactes, complètes et à jour, et à les maintenir telles. L'Utilisateur est seul responsable de la confidentialité de ses identifiants de connexion et de toutes les actions effectuées via son compte.
L'Utilisateur s'engage à utiliser le Service conformément à sa destination et dans le respect de la législation applicable. Sont notamment interdits :
Tout manquement à ces obligations pourra entraîner la suspension ou la résiliation immédiate du compte, sans préavis ni indemnité.
ElixMail propose trois formules d'abonnement mensuel :
Une période d'essai gratuite de 14 jours est offerte à tout nouvel utilisateur. Aucune carte bancaire n'est requise pour l'inscription initiale.
Les paiements sont traités par notre prestataire Stripe. L'Utilisateur autorise le débit automatique de son moyen de paiement à chaque échéance mensuelle. Les prix sont affichés hors taxes ; la TVA française est appliquée le cas échéant.
L'Utilisateur peut résilier son abonnement à tout moment depuis l'interface ElixMail. La résiliation prend effet à la fin de la période payée en cours. Aucun remboursement n'est dû pour les périodes entamées, sauf disposition légale contraire.
Le traitement des données personnelles est régi par notre Politique de confidentialité, qui fait partie intégrante des présentes CGU. En acceptant les CGU, l'Utilisateur reconnaît avoir pris connaissance de la Politique de confidentialité et accepter ses dispositions.
ElixMail s'engage à respecter le Règlement Général sur la Protection des Données (RGPD - UE 2016/679) ainsi que la Loi Informatique et Libertés modifiée. Toutes les données utilisateur sont hébergées exclusivement en France sur l'infrastructure IONOS Cloud (Schrems II compliant).
L'ensemble des éléments composant le Service ElixMail (logiciel, interface, design, logos, marques, base de données, contenu éditorial) sont la propriété exclusive de NovaForma Studio ou de ses concédants de licence et sont protégés par le droit français et international de la propriété intellectuelle.
L'Utilisateur dispose d'un droit d'utilisation personnel, non exclusif, non transférable et limité à la durée de son abonnement. Toute reproduction, représentation, modification, ingénierie inverse, ou exploitation commerciale du Service ou de ses composants sans autorisation expresse écrite préalable est strictement interdite.
Les données et contenus créés ou téléversés par l'Utilisateur (emails, contacts, fichiers) restent sa propriété exclusive. NovaForma Studio dispose uniquement d'une licence limitée pour fournir le Service.
Le Service ElixMail est fourni « en l'état » et « selon disponibilité ». NovaForma Studio s'engage à apporter ses meilleurs efforts pour assurer un Service de qualité, disponible 99,5 % du temps sur une base annuelle, mais ne peut garantir l'absence totale d'erreurs, d'interruptions ou de bugs.
La responsabilité de NovaForma Studio ne saurait être engagée pour :
Dans tous les cas et toutes hypothèses, la responsabilité totale de NovaForma Studio envers l'Utilisateur ne pourra excéder le montant des sommes effectivement versées par celui-ci au titre des 12 mois précédant le fait générateur du dommage.
NovaForma Studio se réserve le droit de suspendre ou résilier le compte d'un Utilisateur, sans préavis ni indemnité, en cas de :
En cas de résiliation, l'Utilisateur dispose de 30 jours pour exporter ses données via les fonctions prévues à cet effet. Au-delà, les données seront définitivement supprimées, sauf obligation légale de conservation.
NovaForma Studio se réserve le droit de modifier les présentes CGU à tout moment. Toute modification substantielle sera notifiée à l'Utilisateur par email au moins 30 jours avant son entrée en vigueur. La poursuite de l'utilisation du Service après cette date vaut acceptation des nouvelles CGU. En cas de désaccord, l'Utilisateur dispose du droit de résilier son abonnement.
Les présentes CGU sont régies par le droit français. En cas de litige relatif à leur formation, exécution, interprétation ou résiliation, et après tentative de résolution amiable, les tribunaux français seront seuls compétents, le tribunal de Toulouse étant seul compétent à raison du siège social de l'éditeur.
Conformément aux dispositions du Code de la consommation, l'Utilisateur consommateur peut recourir gratuitement au service de médiation MEDICYS (app.medicys.fr) ou à la plateforme européenne de règlement en ligne des litiges (ec.europa.eu/consumers/odr).

L'Utilisateur reconnaît expressément avoir lu, compris et accepté l'intégralité des présentes CGU avant toute utilisation du Service. L'acceptation s'effectue par la coche d'une case prévue à cet effet lors de l'inscription, ou par toute action manifestant une volonté non équivoque (création de compte, connexion, utilisation des fonctionnalités).
These Terms of Service ("Terms") govern the access to and use of the ElixMail service ("the Service") published by NovaForma Studio. By creating an account or using the Service, you fully accept these Terms without reservation. If you do not accept these Terms, you must not use the Service.
Use of the ElixMail Service is subject to express and prior acceptance of these Terms. Registration, login, or any use of the Service constitutes full and unreserved acceptance of all the provisions that follow. The User acknowledges having read the Terms and expressly accepts them before any use of the Service.
ElixMail is a SaaS (Software as a Service) AI-powered professional email service, including in particular:
The Service is hosted in France on IONOS Cloud infrastructure, in compliance with GDPR and the CJEU Schrems II ruling.
Access to the Service requires the creation of an account with a valid email address. The User agrees to provide accurate, complete, and up-to-date information, and to maintain it as such. The User is solely responsible for the confidentiality of their login credentials and for all actions performed through their account.
The User agrees to use the Service in accordance with its intended purpose and in compliance with applicable legislation. The following are strictly prohibited:
Any breach of these obligations may result in immediate suspension or termination of the account, without notice or compensation.
ElixMail offers three monthly subscription plans:
A free 14-day trial period is offered to any new user. No credit card is required for initial registration.
Payments are processed by our provider Stripe. The User authorizes automatic debit of their payment method at each monthly billing cycle. Prices are displayed excluding tax; French VAT is applied where applicable.
The User may cancel their subscription at any time from the ElixMail interface. Cancellation takes effect at the end of the current paid period. No refund is due for ongoing periods, unless otherwise required by law.
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By accepting the Terms, the User acknowledges having read the Privacy Policy and accepting its provisions.
ElixMail is committed to complying with the General Data Protection Regulation (GDPR - EU 2016/679) as well as the French Data Protection Act. All user data is hosted exclusively in France on IONOS Cloud infrastructure (Schrems II compliant).
All elements composing the ElixMail Service (software, interface, design, logos, trademarks, database, editorial content) are the exclusive property of NovaForma Studio or its licensors and are protected by French and international intellectual property law.
The User has a personal, non-exclusive, non-transferable right of use limited to the duration of their subscription. Any reproduction, representation, modification, reverse engineering, or commercial exploitation of the Service or its components without prior express written authorization is strictly prohibited.
Data and content created or uploaded by the User (emails, contacts, files) remain their exclusive property. NovaForma Studio only has a limited license to provide the Service.
The ElixMail Service is provided "as is" and "as available". NovaForma Studio undertakes to make its best efforts to ensure a quality Service, available 99.5% of the time on an annual basis, but cannot guarantee the total absence of errors, interruptions, or bugs.
NovaForma Studio's liability cannot be incurred for:
In all cases and circumstances, NovaForma Studio's total liability to the User shall not exceed the amount of sums actually paid by the User during the 12 months preceding the event giving rise to the damage.
NovaForma Studio reserves the right to suspend or terminate a User's account, without notice or compensation, in the event of:
In the event of termination, the User has 30 days to export their data via the functions provided for this purpose. After this period, the data will be permanently deleted, unless required by law to retain it.
NovaForma Studio reserves the right to modify these Terms at any time. Any substantial modification will be notified to the User by email at least 30 days before its entry into force. Continued use of the Service after this date constitutes acceptance of the new Terms. In case of disagreement, the User has the right to cancel their subscription.
These Terms are governed by French law. In the event of a dispute relating to their formation, execution, interpretation, or termination, and after attempting amicable resolution, French courts shall have exclusive jurisdiction, with the Toulouse court having sole jurisdiction by virtue of the publisher's registered office.
In accordance with the provisions of the French Consumer Code, the consumer User may freely use the MEDICYS mediation service (app.medicys.fr) or the European online dispute resolution platform (ec.europa.eu/consumers/odr).

The User expressly acknowledges having read, understood, and accepted these Terms in their entirety before any use of the Service. Acceptance is made by checking a box provided for this purpose during registration, or by any action manifesting an unequivocal will (account creation, login, use of features).
